Datanius Terms of Service

Last updated: October 11, 2026

1. Who We Are and Contact Information

The operator of the website datanius.com and related services and applications is:

2. Scope of These Terms

These Terms of Service (hereinafter referred to as the “Terms”) govern your access to and use of the website datanius.com and every application, interface (API), and service operated by us, including those launched in the future, unless a specific service explicitly publishes its own separate terms. The services governed by these Terms as of the stated date may be specified in an annex or directly on the platform.

If a specific service has additional or different rules, those rules apply to that service alongside these Terms and, in the event of a direct conflict, such specific rules shall prevail.

By creating an account, logging in, or simply using any of our services, you fully agree to these Terms. If you do not agree with them, you must not use our services.

3. Services Are Free of Charge and Under Active Development

Our services are currently provided free of charge and are under active development and testing (beta/development version). Consequently, you acknowledge and agree to the following:

If we introduce paid features or premium services in the future, you will be clearly notified prior to incurring any payment obligation, and such paid services will be subject to specific commercial terms.

4. User Accounts

Certain features require registering a user account. If you create an account:

We may suspend or terminate any account that violates these Terms, applicable laws, or remains inactive for more than 12 consecutive months. Given the free and experimental nature of the services, we reserve the right to terminate accounts at our discretion without stating a reason; in such cases, we will make reasonable efforts to notify you in advance via the registered email address.

5. Acceptable Use Policy

You agree not to use the services in any manner that harms the Operator, other users, or third parties. In particular, you agree not to:

6. User Content and Licensing Terms

6.1 Ownership of Content

Ownership and intellectual property rights to the content you upload, create, or store on the platform (including text, dictionaries, databases, meal plans, photographs, audio recordings, videos, and other materials; hereinafter referred to as “User Content”) remain with you. We claim no ownership over your original content.

6.2 Public Visibility and Default Settings

You acknowledge that certain types of content (specifically created dictionaries, glossaries, lists, or community submissions) are publicly accessible to all platform users and the general public by default, unless the service interface explicitly provides an option to designate such content as private and you have actively selected this private setting.

6.3 License Grant

By uploading or creating User Content, you grant us a royalty-free (without entitlement to any fee or compensation), worldwide, non-exclusive, transferable, and sublicensable license to:

  1. host, store, copy, transmit, technically adapt, display, distribute, and publish such content to the extent necessary to operate, provide, and develop the services;
  2. use the content for commercial, marketing, and promotional purposes of the Operator (including presentations on websites, promotional materials, social media channels, and advertising campaigns);
  3. research, develop, test, and train artificial intelligence (AI) models, machine learning algorithms, neural networks, and related technologies.

6.4 Duration of License and AI Training

Upon deleting specific User Content or terminating your account, our license to publicly display that specific content on the platform terminates (subject to standard technical backup overwrite cycles).

However, the license granted for data already processed for training artificial intelligence models and algorithms, as well as for all derivative outputs, weights, parameters, and model architectures, is perpetual, irrevocable, and survives any account termination or deletion of the original file.

The Operator covenants that it will not sell your raw User Content directly to third parties as a standalone dataset or commodity without your prior explicit consent.

6.5 User Representations and Warranties (Third-Party Rights and Likeness)

By uploading any content, you expressly represent and warrant that:

  1. You are the sole author and owner of the content, or you hold all necessary copyright licenses, authorizations, and legal permissions to upload it and grant the license under this section.
  2. If the User Content (notably photographs, video, and audio recordings) depicts or captures living individuals, their voices, or likenesses, you hold their verifiable, valid, and informed consent for recording, publishing, and commercial exploitation under these Terms.
  3. The content does not infringe upon any third-party copyrights, trademarks, trade secrets, privacy/personality rights, or applicable statutory laws.

6.6 Liability and Indemnification

You bear sole and exclusive responsibility for ensuring that your User Content complies with applicable laws and third-party rights. If any third party (including individuals depicted in media or copyright holders) brings any claim, lawsuit, penalty, or regulatory action against the Operator, its affiliates, or representatives arising from the use of your User Content, you agree to fully indemnify and hold the Operator harmless.

This indemnification obligation includes compensating all incurred direct and indirect damages, non-material harm, administrative fines, and reasonable legal defense and court costs.

7. Behavioral Analytics, Aggregated Data, and Advertising System

We operate and develop analytical and advertising mechanisms connected with commercial partners and merchants (hereinafter referred to as “Merchants”). In this regard, the following terms apply:

7.1 Behavioral Analytics and Profiling

The Operator collects, tracks, and analyzes user interactions with the platform (including interest categories, browsing history, purchasing trends, content engagement, and ad interactions). This data is processed to enhance services and generate aggregated consumer behavior analytics.

7.2 No Sale of Individual Personal Records

The Operator guarantees that it does not sell, rent, or disclose raw personal identifiable records of individual users (such as names, email addresses, phone numbers, or individual activity logs) to Merchants or third parties without your separate, explicit consent.

7.3 Delivery of Aggregated Data Packages

The Operator may generate statistical reports, market intelligence, and consumer trend compilations, and may offer or license these aggregated reports to Merchants. These packages are provided strictly in an anonymized or aggregated format from which individual users cannot be identified or singled out.

7.4 Targeted Advertising for Merchants

The platform allows Merchants to configure and deliver advertising campaigns targeted at specific user interest segments and groups. Targeting occurs entirely within the Operator’s internal systems. Merchants receive no access to the identity of users who viewed or clicked on the ads, unless the user voluntarily provides their personal data directly to the Merchant (e.g., by clicking through and completing a transaction on the Merchant’s website).

Personal data processing for behavioral profiling and targeted advertising complies with our Privacy Policy and requires consent under applicable law (GDPR and ePrivacy Directive), which users may withdraw or manage at any time in their account settings.

8. Operator Content and Intellectual Property

The services themselves—including source code, software, algorithms, user interfaces, database schemas, graphics, trademarks, logos, and the name Datanius—are the exclusive intellectual property of the Operator or its licensors.

You receive only a limited, non-exclusive, non-transferable, and revocable right to access and use these elements solely for regular personal or business use of the platform in compliance with these Terms.

9. Availability, Data Loss, and Backups

You are responsible for maintaining your own independent backups of all content, files, and data uploaded to the service.

The Operator exercises reasonable technical care, but a free service under active development is not an archiving or backup service. We assume no liability for the loss, corruption, deletion, or unavailability of any data stored on our platform.

10. Disclaimer of Warranties

The services are provided “as is” and “as available”, without warranties of any kind, whether express, statutory, or implied.

To the maximum extent permitted by applicable law, the Operator disclaims all warranties and gives no guarantees that:

Do not rely on Datanius services in safety-critical situations where an error could cause harm. Nothing generated by the platform constitutes professional medical, health, nutritional, financial, investment, or legal advice. Where decisions carry risks of financial loss or personal injury, verify all information through qualified, certified authorities.

If you are a consumer, this section does not limit your statutory warranty rights under mandatory consumer protection laws.

11. Limitation of Liability

Nothing in these Terms limits or excludes liability that cannot be legally limited under applicable law—specifically liability for intentional misconduct (willful intent), gross negligence, bodily harm, injury to fundamental personal rights, or statutory consumer protections.

Subject to the preceding sentence and to the fullest extent permitted by law:

12. Termination

You may cease using the services and delete your user account at any time via the platform settings (where available) or by emailing your request to hello@datanius.com.

The Operator may terminate or restrict your access to the services at any time pursuant to Section 4. Provisions that by their nature are intended to survive termination (including AI training licenses, disclaimers, liability limitations, indemnities, and governing law) shall remain in full force and effect.

13. Amendments to These Terms

We reserve the right to amend these Terms unilaterally (e.g., due to legal changes, technological advancements, or changes in our operational model).

Updated Terms will be published on the website with a revised effective date. If an amendment is material and we have your email address, we will make reasonable efforts to notify you in advance. Continued use of the services after the effective date constitutes acceptance of the amended Terms. If you disagree with the changes, you must discontinue using the platform and delete your account.

14. Governing Law and Dispute Resolution

These Terms and all disputes or claims arising out of or in connection with them or the use of Datanius services shall be governed by and construed in accordance with the laws of the Czech Republic, excluding its conflict of laws principles and the UN Convention on Contracts for the International Sale of Goods (CISG). Any legal proceedings shall be submitted to the exclusive jurisdiction of the competent courts of the Czech Republic.

Consumer Protection Rights:
If you are a consumer habitually resident in the European Union, this choice of law and venue does not deprive you of mandatory consumer protections provided by the laws of your home jurisdiction, and you may initiate proceedings in your local consumer courts.

Pursuant to consumer protection legislation, consumers have the right to out-of-court resolution of consumer disputes (ADR):

15. Force Majeure

The Operator shall not be liable for any failure, delay, or interruption in performance caused by circumstances beyond its reasonable control (force majeure). Such events include, but are not limited to: cloud hosting or telecommunications carrier failures, internet backhaul outages, power grid failures, cyberattacks, strikes, civil unrest, acts of war, terrorism, natural disasters, epidemics, or regulatory interventions. Obligations shall be suspended for the duration of the force majeure event.

16. Final Provisions and Prevailing Language

These Terms may be made available in multiple languages (notably English, Czech, and Slovak). In the event of any discrepancies, ambiguities, or interpretation conflicts between language versions, the English version shall prevail to the maximum extent permitted by applicable law.

If any provision of these Terms is deemed invalid, void, or unenforceable, the validity and enforceability of the remaining provisions shall remain intact. The invalid provision shall be replaced by a valid provision that most closely reflects the economic and legal intent of the original provision.
